Employment-Based Immigration: first Preference EB-1
You may be qualified for an employment-based, first-preference visa if you are an alien of extraordinary ability, are an impressive teacher or scientist, or are a specific international executive or supervisor. Each occupational classification has particular requirements that should be satisfied:
Your petitioning employer must be a U.S. employer and intend to use you in a managerial or executive capability. The petitioner should have been doing service in the U.S. for at least 1 year, as a legal entity with a certifying relationship to the entity that used you abroad in a managerial or executive capacity.
No labor certification is needed.
* Criteria for Demonstrating Extraordinary Ability
In order to demonstrate you have sustained nationwide or international acclaim and that your achievements have been recognized in your field of competence, employment you must either consist of evidence of a one-time achievement (significant internationally-recognized award) or 3 of the 10 noted requirements listed below (or similar evidence if any of the criteria do not readily apply):
– Evidence of invoice of lesser nationally or internationally recognized prizes or awards for quality
– Evidence of your subscription in associations in the field which require impressive accomplishment of their members
– Evidence of published product about you in professional or significant trade publications or other major media
– Evidence that you have actually been asked to judge the work of others, either individually or on a panel
– Evidence of your original scientific, scholarly, creative, athletic, or business-related contributions of significant significance to the field
– Evidence of your authorship of academic posts in professional or significant trade publications or other significant media
– Evidence that your work has actually been displayed at artistic exhibits or displays
– Evidence of your efficiency of a leading or important role in recognized organizations
– Evidence that you command a high wage or other considerably high compensation in relation to others in the field
– Evidence of your industrial successes in the performing arts

** Examples of Documentary Evidence That an Individual is an Impressive Professor or Researcher
In order to demonstrate you are an exceptional professor or scientist, you should include proof of 2 of the 6 listed requirements below (or similar proof if any of the criteria do not easily use):
– Evidence of receipt of major rewards or employment awards for outstanding achievement
– Evidence of membership in associations that need their members to show outstanding accomplishment
– Evidence of published material in expert publications written by others about the alien’s work in the academic field
– Evidence of participation, either on a panel or separately, as a judge of the work of others in the same or allied scholastic field
– Evidence of original clinical or academic research contributions in the field
– Evidence of authorship of scholarly books or employment posts (in academic journals with international flow) in the field

Application Process
Extraordinary Ability: You may make an application for yourself by submitting a Type I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. company should file a Kind I-140, Petition for Alien Worker. As part of the application process, your company must have the ability to demonstrate a continuing capability to pay the used wage as of the priority date. Your company may use a yearly report, federal tax return, or audited monetary statement to show a continuing capability to pay your wage.
Multinational Manager or Executive: Your U.S. company need to file USCIS Form I-140, Petition for Alien Worker. As part of the application procedure, your company should have the ability to show a continuing capability to pay the provided wage since the top priority date. Your employer might use an annual report, federal tax return, or audited financial statement to show a continuing ability to pay your wage.
